140 RFE Gurus need help.. 3 (Three) year Engg Degree..

Hi gurus,
Just now I got the RFE from my paralegal.
The RFE states “It has been determined after review of the petition, supporting documentation, and the advisory evaluation of the alien’ s credentials that additional information must be provided since the Service does not historically recognize a foreign three-year diploma as the equivalent of a four-year U.S. degree.”


I have 10+2+2+3 education. Does anybody have any idea how respond to this. I will talk attorney but if somebody can give some suggestions or hints that will be great.

My ETA says:

Bachelors or Foreign Equivalent. Major field Electornics and Comm Engg.

Can we add Combination of degree NOW in the labor certification?

I have 3 year engg degree after the polytechnic and I did 10+2 and got into polytechnic second year.

If anybody have any suggestion or threads where I can find the info that will be great. Anyone who got approval of 140 with 3year engg degree please respond to this.

Thanks for your input. I did my evaluation earlier with TrusteForte company. They did a decent job too. But the person in USCIS is thinking that I have an Diploma from Polytechnic. There was definately some confusion. Talking to Attorney.

I had similar issues, but went to Trustforte again to reevaluate with correct wordings. Better show your RFE to you Trustforte people, so that the evaluator writes it correctly acceptable by CIS. Trustforte may ask you to pay fee again, but it's worth to spend another $200-300. It really worked for me.

Could you please give more details about your case. What was the RFE what kind of documents you are needed. Please share this. I am waiting for my attorney's call. Did you get any documents from India too at the time or reevaluation? Please let us know. Also is it with NSC.

That's correct, my application was filed at NSC.

My case actually got denied, I have 3+3 year degree. So your case is similar to
mine, hope you get your approval after replying RFE. I feel RFE is better than
sending denial letter, so you have an opportunity to produce the right documents
to get it approved now.

I didn't get any letter from India, but make sure you get the evaluation stating
US equivalency BS degree. (that's one single degree).Trustforte is doing wonderful job in explaining to CIS about all degree programs.

In my opinion, most of the time adjudication officer prefer to see it one 4 four years degree program on one transcript even with multiple colleges as like in US
education system. The reason why you have completed 4 years degree program in 3
years is, the fact that you already earned 2 year Diploma in Engineering. It
doesn't mean that you don't have 4 years US equivalent degree.

In USA, it's very usual that people move different colleges and transfer their credits to earn degree and at the same time the degree transcript printed with all
credits earned instead of just that one college.On the other hand, we do not have these kind of documents to produce in one single transcript. So the evaluator has to explain everything in writing.

Thank you very much for the reply. I also did evaluation earlier with TrustForte. My attorney is showing very good interest in my case. I have an appointment with him today and once I explain my educational details then he will talk to the evaluator. Do you have any idea who did your evaluation if you have that info only. Mine was done by Barry S. Silberzweig. If this the same person then I think I have some chances. Again Thank you very much for you time. Really Really appreciated.

Some more quick questions?

Were your 3+3 is like (polytechnic + Engineering?) or something else?

One yous application is denied then did you open MTR? Was it approved in the NSC center itself ot did it go to AAU office?

How long did it took to get the approval after appeal?

Based on these things I will try to plan my future.

Thanks again.. This 140 is the only chance I have to get my GC. I dont want to start again with another company so is the reason gathering all the info. Please respond to this post.
