140 Redo Approved (RFE 485)

Just now heard the AVM. My 140 has been approved on April 11. AVM was not updated yesterday. Lawyer did not receive the approval notice yet.
140 receipt # WAC-01-097-5xxxx (ND 2/5/01, AD 4/11/01).
I guess now lawyer has to mail back the approval notice to CSC so that my pending previously processed 485 can be adjudicated in 975 to 999 days ! It is not even funny. My GC wait is close to 5 years.

How long does 485 approval take after 140 redo. It would be too much to ask for CSC to match database and approve 485 automatically now that the RFE has been satisfied. One interesting point to note is that the 140 was sent with the RFE letter. I would appreciate if somebody could shed some light.

Hopefully it will not take to long. Your case is very much like ours so you gave me little hope that redoing I-140 doesn\'t take that long. Good luck to you and please keep us posted. I remember seeing few postings where people got approved quickly after RFE was received - hopefully you will be one of them too.

Congrats! I\'m on the same boat. I got my new I-140 (redo due to company merger) approved last March 12, 2001.

Luckily, I got a hold of an IIO just now after waiting for 30 minutes. She is very kind and she told me that my case is still on the shelves after the RFE. She also told me to contact the INS, every week to check on the status of my I-485 since I\'ve already passed RFE (new I-140 approval). So I hope we will get our I-485 case approved soon.

Hey, Waiting_Man,

When the IIO tells you to "contact" INS every week, does she mean to call and talk to an IIO, or does she mean check on AVM? Do they encourage us to call them when there\'s RFE related issues?

Hi bacard_151 and Smile,

My assumption to the suggestion of the IIO is to call them and at the same time check the AVM and if you can talk to an IIO do it. But you know it\'s really hard to contact an IIO. It took me 30 plus minutes just to get a hold of an IIO.

With regards to the 140 redo approval, the IIO told me that we don\'t need to submit the approval notice because they already know the WAC number for my I-140, but still it\'s bad to hear that my case is still on the shelves. The IIO told me that they can see it on the computer if my case has been assigned again to an officer again.

Here is my info regarding my I-140 redo:

I-485:
RD : 09/18/2000
ND : 09/20/2000
FP : 11/03/2000

RFE : 12/30/2000 (Company Merger, Spin-Off)

New I-140:
ND : 02/20/2001
AD : 03/12/2001

Yes, I filed my new I-140 after receiving the RFE from CSC. Hope this helps us all. Thanks.
