I have a situation here and I would need some help or advice from all you experts.
First LCA filed was filed from company A in dec 2004 it was cleared after a long wait of 3 years from back log (i.e some time in 2007), When the whole mess with visa buletin happened in July 07, I have filed 140 and 485. note 140is filed on EB2. (My attorny actually suggested me for EB2 and very well know that i will not be qualified in terms of USCIS Assumptions, even i have the wordings right in LCA and experiance req).
Knowing the issue i have filed a new labor in 2007 and was approved from COMPANY A. 140 is approved.
By having 140 approved under perm labor with PD 2007, I am thinking to file another 140 using the labor filed in 2004 under eb3. (the same labor on which EB2 was denied in 2007)
What would be my chances? Is it possible? if possible what are my odds will this put me in a situation of lossing new 140?
what would be my PD assuming that i got approved 140 using 2004 labor ??
I have not changed the company till now. I am with same company A all the while, and no have no thoughts of changing employer.
