Friends, my 140/EAD/AP ND is May 20,2004. EB3/Subs labor. EAD and AP approved couple of months ago.

After no movement on my 140 since the ND, the LUD now shows 10/19/04 (yesterday) with no change to the status message. I see that most participants in the 140 EB3 tracker with ND more recent than May 20th have their 140s approved. Is this a sign of an RFE brewing? I am trying not to stress out, but it certainly is getting to me. Would appreciate any pointers.

Same boat

My I-140 ND is jun 10 and the LUD changed on sep28 2004...still waiting.

Possible RFE(thats what I am expecting) is the current thought among many fellow members although few of them got their I-140s approved.

How big is your company, is it well known? and do you happen to know if you have made profits over all the years ever since your GC was filed...these may help decide if you will be RFE'd or not - For more info, you should check, "Ability to Pay, as promised by United Nations"

Jolpot, My company has about 1500 employees and has been net cash flow positive for several years and so was hoping that 'ability to pay' issues would be be triggered here. My credentials also appeared to match the pre-approved labor pretty closely and so I am indeed concerned.. I guess it's a wait and watch game..
