140 laborSub advice needed. Help please

Hi All
I am planning to apply for 140 with Labor Sub. One of the collegue in my firm left in Aug'01 and his labor got approved after that. My company is planning to use his labor and substitue it with my 140.
I just wanted to find out whether the match is appropriate or not. The salary and number of years of experience is perfectly matching mine salary and exp.
As far as eduction is concern my graduate degree is M.S. in Civil Engineering and on the approved labour is mentioned
Master in Computer Science or Engineering or Equivalent.
My lawyer is telling that since on the labour it says CS or Engineering or Equivalent, mine Civil Engineering degree falls under Engineering or Equivalent category and I will be fine. But after seeing so many post, I feel that they are very strict on Labor Sub cases.

So Jim or any other guys, I wanted to know whether if I apply 140 with the above labor what problems I might face in getting 140 approved?

Any suggestion or help will be appreciated.

I AM NOT TRYING TO CONFUSE U..
and nor i am very knowledgeable in this issue.

But my first interpretation when i read ur post is.

when it said "Master in Computer Science or Engineering or Equivalent"....i wud interpret as

Masters in COmputer science OR
Masters in COmputers Engineering
Or equivalent.
I remember that when I did my masters quite some time ago..abt 4 years I remeber branches like
COmputer Science,
COmputer Engineering
COmputer Science and ENgg
Information Science
Etc......

Please be sure...cos...I know INS is being strict these days.....
 
Get an evaluation. If the evaluator says that your degree is equivalent then you will have no problem. Don't use experience for this evaluation since that was not specifically stated in the LC.

My guess is that it is not equivalent. But that's why God made educational evaluators.

Can you let me know how to do the education evaluation? Is there any website for it. Also while doing my Master in Civil Engineering, I have done 10 extra credits of courses related to Computer Science, and that is there in my transcript. Will it help?
 
This has always been a point of confusion and gray area.

Let me post another question (to add to the confusion).

Say if the LC said.

BS in EE/CS/CE or related occupation and if someone has an equivalency in BS in CIS (done thru an evaluator), will the INS accept his qualification as been equivalent to what is required, i.e equivalent to EE/CS/EE? Furthemore, how does the INS define the term "related occupation" or do they even consider it? What does this term related mean? Does related mean that a person with a CS degree can do the same work as a person with a CIS degree?

Once we figure this out, we can ask the question what criteria the INS uses to judge if a degree in CIS or Civil Engineering is related to a degree in CS? Does the INS from experience know CIS could relate to CS but a degree in Civil Engineering cannot?

Thus, getting an evaluation from a evaluator saying that a degree in CIS is related to CS?

Thus, in my opinion, like what Jim said, getting an evaluator to say a degree in Civil Engineer is related or equivalent to CS would do the trick, but again, how does INS interpret the term related?
