140 July receipt date

Present contract job is going to be over by 12/31/2002. Planning to take 4 weeks unpaid vacation in January 03. Will that jeopardize the Green card processing at any point down the line? Please advise whether I can go for unpaid vacation and try for new jobs after a month.

You should be fine going on the unpaid vacation. The fact that your project is ending will not have an effect as you will still be a valid employee in your organization.

Go, take your vacation and forget about all the RD, ND, Ad for a while ...... :)

Checked with my employer and lawyer and they suggesst to lookout for a new job within next 30 days or to get terminated as per new law.

Another prospective employer advised me to check whether VSC does premium processing for I140 so that it can be expedited.

Please let me know how crucial the 30 days law is and also whether VSC has started implementing premium processing for I140.

By your message it appears to be you haven't applied for AOS :(. What do you mean by termination ?. Are they going to cancel your H1B?. If so, they may not even care for your GC too. Employer has authority to cancel your I-140 and using LC for some one in the company. I am not trying to scare you, but please be aware of all this and make a smart move.

Actually there is no law such as "30 days law". In fact there is no such grace period w/ H1B, as per law. It all depends on your employer and I know lot of people w/o being on payroll and still continues their H1B and also GC. You need your employer support for any RFEs you may get and later to apply your I-485.

There is no premium processing for I-140.
