140 form doubts !

The salary mentioned in my LC is 70k. Currently my employer is paying 64k. My LC is pending & may get approved soon. I am preparing the doc for 140 now. My company is a middle size industry, having 90 employees in US and 150 employees in Mexico.

Now I have a question in giving data to Lawyer!

1) The total number of employess counted only to US or total?
2) At what stage of the green card process, the employer should pay the salary mentioned in the LC to avoid any RFE?
4) If my employer says to CIS they pay the LC salary only after getting the CARD, will it lead to any RFE/denial of I140?
3) What is the significant of question #8 in 140 form "Is this a new position?
(Y/N)"? If it is a new position will they deny 140?
