Can 485 be active if 140 is denied for wrong category???
Hi,
We applied for 140/485 in June 2003. 140 was rejected because of wrong category.
Our lawyer applied again on Dec 2003 for both 140/485. My EAD got approved in Jan 04 and AP is denied for rejected status of old 140/485 appliction. But the strange thing is we did FP on 04/24/2004 which mentions the old 485 receipt date.
I have following questions,
1. Can the old 485(RD 06/08/2003) be still active? And our lawyer shouldn't have filed new 485(Which we filed on 8th dec 2003.)
2. Are EAD and AP tied to 485 or 140. So we are not sure whether we should consider the 485 RD as june 03 or Dec 03??
3. From 140 excel scanner, it shows the case was scanned on 04/26/2004.
What does it mean by scanned?
