I am currently with Company A and working for them. They have filed my I-485 case.
These are timelines.
Labor PD Dec 2001.
140 approved - Oct 2002.
Laid of Dec 2002 from Company A.
Company A requests H1B revoke in Feb 2003.
Rejoined Company A in July 2005.
485 filed by company A in June 2005 using previous labor and approved I 140. Received 4 EADs and 3 Advance Paroles and waiting on another Advance Parole.
RFE issued for marriage certificate and employer verification - Feb 2007.
7th year H1b extension approved - August 2007.
I called USCIS to ensure I should be OK to change the jobs on AC21 and they tell me now that 140 is revoked back in April 2003.
USCIS cant give me any answers. I am still working for same company.
My company says they never requested a revoke on I 140. My company is a publicly traded large company and has got GC's to lot of employees.
I am just looking for all ways to rescue my I-485. Please suggest.
