140 Approved EB3

I just saw that my 140 has been approved as of Apr 12, 2004 on the USCIS web site. My application details are:

EAC031985*****

RD: 06/26/2003
AD: 04/12/2004


I have a question though. Now my H1 is expiring end of next month and my EAD application is pending. Going by the current trend, it won't be approved before expiry of H1. Now that my 140 is approved and i am in 485 status, do i need to renew H1 or can i work based on approved 140/EAD pending status? Any detailed suggestion is appreciated.

Congrats! Pls update the 2003 tracker.

There are so many scenarious. If your company is willing to process the H1 extension, then go that route, that way you will be safe until you get the GC.

Also since ur 140 is approved, you might switch over to EAD. I think you can get interim EAD if you have waited 90 days or so. I remember reading about this somewhere in this forum.

But remember once you switch over to EAD, and then decide to use H1 later, you will have to go out of the country and reenter.

I was confused. Suppose I have an H1B at this moment. I also got EAD.

what happens when I renew my H1B???

do i have to reenter the country???

No, you should be fine. Getting EAD and using EAD are two different things. If you use EAD then your H1 is not valid, and if you decide to switch to H1 later, you will fall under that year's quota and have to reenter. You can search for more information in this forum. This has been discussed earlier.
