140 and 1485 question.

My LC is approved after 18months. And my H1 6year limit is going to expire on NOV 2003. Iam from NSC center. I have following questions.

1. Should i just file 140 , 1485 concurently and EAD only.

2. Should i file 140, 1485 concurently and H1 7th year extension also.

3. If i don't file 7th year h1 extension and my EAD is not issued by NOV 2003. will i be out of status.

Please help.
 
1. U can file 140 and 485 concurrently.
Also file for EAD and also AP.
If u start using EAD for working - u need AP to travel out of
US and enter US.
2. Filing for 7 th yr extension allows u to continue
working on H1 without waiting for EAD.
But apply for EAD and keep it in hand.
3. When u file 485 u are on AOS, So u will be in status, even if ur
H1 expires.
But since ur H1 has expired, u need EAD to work.
If u dont have EAD approved by the time ur H1 expires u
CANNOT work.
U either need EAD or H1 to work.
 
Best bet in your case is File H1 b extension and play the game other wise if you dont get EAD by Nov .. you are gone case !!
So play game safe ..
