Hi

One of my friend filed I140/485 together its been 6 months since he filed them. He has EAD. His I140 is not approved yet. He is having a very attractive offer from a Client. Can he switch to a New employer using Portability.

He/she can switch to a new job using AC21 provided the current employer can assure that they would not revoke his/her I140 untill it is approved.

Else it is better to wait untill the I140 is approved to be safe.
 
Advise your friend not to change before I-140 approval. He will be in big trouble if he gets a RFE for I-140 after changing job. Ask him to explain his client about the GC situation and request for some more time to accept offer.
