140/485 status if company ceases to exist

Hi All,

I am in big trouble with my GC status because my company probably going to be outof business this month. I already applied for I-140 and I-485 with concurrent filing option. I haven't yet received my EAD

I-140 and I-485 concurrent (EB2 option)
RD: 02/20/03
ND: 03/19/03

What are my options now? If I get EAD which I am expecting in 2-4 weeks, can I use EAD to change emploment? Do I have to inform to INS? or can I inform once I qualify for AC21 rule?

Can I take new job as full time since I am out of previous company payroll?

What kind of RFE can come fom BCIS, considering my filing dates and status of my company?


Is CP better option, if some miracle happens and get my I-140 in 2-3 months!!! What do I need to at this stage to cancel my I-485 and go for CP?

Hi,

I am in the similar position. I have two months to pass the 180 days. I have not receive EAD yet, it has been filed for more than 90 days. I am not sure even if we got EAD, can we change the job before 180 days while I-140 is still pending? Thanks.
