140/485 Job Verification

I worked for Company ABC, project was over and I got terminated. Sometimes they rehire after they find another project. They did not cancel my H1. So I joined company XYZ transfering my H1 and starting GC.

Now my previous company ABC called me asking me to join them. They got me a project and they are currently doing a labor substitution for me.

In the labor certification form, ETA 750 Part B, we have to list all jobs we have held in the past 3 years. I did not mention company XYZ in the labor certification form and in the Biographic information form for I 485. The reason being that company ABC will come to know that I worked somewhere else in the bench time and moreover I was with company XYZ for 3 months only.

All I have in the labor form and biographic information form is Company ABC and other companies that I have worked for in US.

Will this cause any problem during the I 140 or I 485 stage as I did not mention anywhere that I worked for company XYZ?

Any suggestions will be definitely helpful.

U should have mentioned XYZ !!

I think you should have mentioned that u worked for XYZ Company..
Because benchtime is not supposed to be a good time...and infact if USCIS asks your W2 for that year ..u should have atleast the prevailing wage as mentioned on your labor !!!

I think (I hope not) it might create a problem in future..!!

So it will look like this in the labor and biographic forms.

Company ABC XX/2002- XX/2004
Company XYZ XX/2004- XX/2004
Company ABC XX/2004- Present

Will this look OK on the forms?
