140 & 485 denied..

Dear Friends..
my 140 and 485 denied..
notice issued on Jan 11th, recieved on 14 or 15th.
niw case, denial says third prong(Labor issue) not satisfied..
had begun journey in 2002, got fooled by first employer,had no way and later began the niw preparation which took almost 12 months..

I am extremely sad to hear this. Dont loose hope and tell us what the labor says and what are your education details. You can still appeal the denial for 140 if you think that the denial is unjust. But you need to act fast as you have only 33 days from the denial date to submit your appeal. Please tell all the details and someone on this board can help you.

Dear Dazzling..
Thank you very much for your kindness and inspiration..i gratefully remember you having quickly answered my earlier queries regarding change of luds/140 issues, posted a month before regarding your analysis of the cases and i guess your analysis matched up rightly even though it was sad..the denial notice says about LC certificate waiver issue ( they address it as third prong), which is most common ground for denial of NIW cases..for which appeal/MTR doesn't really work, i read most of decisions by ins at the ins website http://uscis.gov/graphics/lawsregs/admindec3/b5/2004/index.htm and found most of them are denied/appeal dismissed again..so i know it is not of any use as most lawyers also say. But just with a Prayer to God, would appeal..
