Hello Pandits please help me by answering below questions regarding my 485/EAD filing.
My Case details
EB-2 Perm case Advance degree ( M S in computer science in US)
I am working as a software consultant in Charlotte, NC
My company has Head office in Vermont and no office in Charlotte, NC
Labor approved on 25 August 2005 and labor applied for Charlotte, NC
Concurrently filed 140/485/EAD before October ,2005 deadline.(reached VSC 28th September)
VSC rejected the package saying not in their jurisdiction (since labor applied in charlotte according to my attorney).
As the dead line was crossed only 140 is applied to TSC and approved on 19 November, 2005
Worst of all my attorney and employer told me this yesterday when started bugging them regarding my 485 and EAD case numbers.
Questions
1) Is my labor valid as it is applied for Charlotte, NC and my company has head office in VT(no office in Charlotte, NC)
2) Is it safe to apply 485 and EAD through TSC when priority date will become current for my case
3) What will happen if I move to another state for another assignment working for the same employer (this happen all the time to software consultants)
4) Can I resubmit my 485/EAD to TSC saying that it was originally submitted to TSC before deadline.
5) Can I resubmit my 485/EAD to VSC with the approved 140 from TSC
