12/31/2004 Deadline and PERM

Hi All,

I see someone mentioning about 12/31/2004 deadline for RIR case.
What is this about ?
I'm not sure my lawyer has file LCA or not but he was telling me the he will file in december 2004.
Does this dealine means that all applications filed after 12/31/04 will be considered under PERM?
or Applications filed after 12/31/04 can not be converted to PERM.
or what ?
My green card is being processed from Arizona state so I think I should not be effected because labot is anyway fast there.
Can anyone suggest me about what this all about ?

12/31/04 - Last day RIR and Regular applications get sent to SWA
1/1/05 - 3/27/05 - RIR and Regular applications get sent to NPC (national processing center)
3/28/05 - PERM goes into effect, RIR and Regular applications no longer accepted.


Even though Arizona SWA is fast your case will likley end up in the BECs (backlog elimination center) since SF DOL is forwarding all their cases. Or it may just not even get processed at Arizona since all SWA cases need to be transferred out of SWAs by 3/31/05 to the BECs.

I have a question about what happens when RIR and Regular applications get sent to NPC's. What will be the processing times be like since these NPC's will become dedicated to processing PERM applications 3/28/2005 and onwards.

between 1/1/05 and PERM launch date they will take and process RIR and Reg Appl in the order received....

I guess that is what they will do....and processing time will certainly be longer than PERM proposed timing but a lot less than current multi-year timelines for RIR & Reg L.

....just my 2 cents.... :)

i mean, who knows for sure how many applications they already received at NPCs????
Do you know what happens if they do not finish processing/get to my Reg Appl before they start processing PERM? Where does my application end up then???
 
Hi !

My friend has a labor application pending from company A in EB3 category. Now he wants to join company B and file a Perm application in EB2. he has friendly ties with company A so that they wont withdraw his application in regular labor.

Do you guys think that if he files a new Perm application it will negatively affect his regular application ? If the PERM application is denied from company B, can he go back and work in company A and use the regular labor if approved by then ?

I heard somewhere that DOL will not allow duplicate filing, but will it allow duplicate filing if employres are different and employee is the same ?

Any suggestions ?
