1099 on EAD

Hi,

I am the primary applicant on our GC application. We are on our I-485 stage and have got EADs.

My wife is using her EAD to work. Till now, she was being paid on W-2. But recently, she lost her job. She found another job but the employer is insisting on giving 1099. It it legal to work on a 1099 on a EAD .... remember she is a dependent on the GC application. What other concerns, if any need to be addressed to work on 1099.

Sure. No issue here. EAD gives your wife an unrestricted access to any employment opportunity. 1099 or W-2 does not matter at all.
 
Related to GC? Maybe None

But if you are asking in general, I guess you might want to keep the following in mind:

1. Make sure that the employer pays 30-day net. What it means is that your wife gets paid only after 30 days of submitting her invoice. Normally, they trick you(I mean your wife) into signing a 45-day net.

2. They might ask for additional insurance coverages which will eat into your earnings

3. Might be subject to advanced tax (meaning you might have to pay taxes to IRS and state, etc. on a quarterly basis)

4. You might want to consider the expenses of hiring a CPA for managing all these too.

etc. etc. life goes on.....
