10 years for US Citizenship , how many years for Indian ??

Hi ,

We almost spend 5 years for GC and wait another 5 years before we get US citizenship. A total of 10 years.

Now for whatever reason if person wants to claim back the Indian Citizenship again what is the process and how long will it take ??

Is PIO card equivalent of US GC in India.

What rights does a PIO card holder not have when compared to a Citizen ?? I am assuming voting is one of them ?

How about buying assets in India as a PIO card holder ? If you already holding assets like real estate etc , can you continue to still hold them ?

How about childern's education in India as a PIO Card holder ?? Are they eligible for any university ?? what quota will they have ? Can they still avail reservations on a PIO Card ??
Will the fee be same as for a citizen or will it be some exorbitant fee ??


PS : Also Congratulate me on my Century. I mean this my 100th posting on this forum since I registered on this forum on 23rd july,2003 . It 's been exactly one week since I registered.

If you are a Citizen of India before your I-485 (Green card) approval, you will remain citizen of India after approval. Govt. of India is comming with Dual Citizenship and is expected to be implemented in the comming years. Hope this will happen before you apply for US Citizenship.

Is PIO card equivalent of US GC in India
PIO Cards are issued to people who are
(1) not born in India and atleast one of his/her parent or grand parents are citizen of India. Or,
(2) Citizen of other country by Naturalization but Citizen of India at the time of Birth.

With, PIO Card you are eligible for the rights of a citizen except that you cannot participate in political process in India and you cannot work in some Govt. jobs (like defense, Atomic Energy). Your absence in India beyond 6 months will not cancel your PIO status. With Green card, if you are outside US for more than 6 months in a year, it affects you acquiring US Citizenship. With PIO card, you can enter and stay India as long as its valid. With Green card, you have to get BCIS approval if you want to stay outside US for more than a year.

Apart from voting, you cannot work in some Govt. jobs. Also, you have to pay the higher educational fees set for NRI (Higher than the citizen's rates)

Admission can be obtained in all Universities, IIT's etc. on NRI Quota. Fees are exorbitant.

My client is really cool. Ofcourse my current contract is ending next month. So i may not be posting here after August. I will take a back seat and enjoy reading the posts by others (ocourse not from work).

With regards to your statement on Dual Citizenship, I am not sure if this will materialize soon or not ??

Assuming Dual Citizenship is not available , how long does it take to get back Indian Citizenship if we are ready to forfeit US citizenship ??

Is also two stage process as in US like GC to Citizen . I mean PIO to Citizen or can we directly apply for Indian Citizenship ?

Thank you. I hope Dual Citizenship for PIO's must come into effect soon before the next general elections in India. NDA Govt. at India has already approved it. Political Parties in NDA must be getting lots of donation for election campaign from NRI's & PIO. Its well known that NDA is pro NRI's & PIO's especially for people from US, UK & Canada. They have to move forward on implementing it. The hope is like waiting for getting Green card in US :) . I am sure it will come into effect one or other.

Thanks for your wishes. Your wishes already have some effect. Yesterday evening, my Manager called me and told me that he is extending my contract by 1 month (He seems to have been impressed with my internet skills) . The 1 month extension is especially sweet because there is a rule here that contractors can not work for more than 1 year continuously. I will be completing 1 year here in August, but now i will be here till almost September end.

Regarding Dual citizenship, it is going to be passed by parliament before the end of the year. That is guaranteed.

I too hope it will come into effect.

But my fear is most of the funding from NRI from US,UK, Canada go to NDA/BJP.

So for Congress there is little stake ?

They will politicize this issue and throw a spanner. Also If I remember correctly I beleive Italy is not one of those countries . So surely Sonai will not be interested as she will not have Dual citizenship.

Forget about Sonia comming to power. Our guys will never let her come into power. She will never be accepted as prime minister by majority of Indian voters. Congress has burnt their fingures in last general election projecting Sonia as PM. This time, congress may seek Priyanka. May be if Priyanka seeks for PM, Congress can come into power. If Priyanka comes as PM, she may not be against Dual Citizenship.

Let's hope for implementation of Dual Citizenship in India before the comming General elections.
