Hi! This is my first time on here!
Just have a couple questions! I have a lawyer who is giving me the run around. First does anyone know if you can fire your lawyer? I paid him $500 upfront and now he demanded the day before my interview for the green card, the balance of the fees upfront or he would not go to my interview with me and my husband. So we did not have the money to come up with the following day and he did not come with us. Needless to say they had made a few mistakes with the paperwork which the INS questioned us about.
Well the interview went great, no other problems. The officer did not stamp my passport however, but i did get a letter in the mail 4 days later to say that i would be recieving my 10 year Permanent Resident Card in a couple of weeks in the mail. My question is (because all this stuff is a royal pain in the a**)!! What kind of condidtions would i have on the 10 year card if any? I overstayed my visa a few years ago, so would i be able to travell out of the country on the 10 year card or would i have restrictions, and if so how do i go about doing this?? And how do i get my passport stamped?? I called my lawyer today to find out all this but of course wanted the balance of his money before he would answer any questions so i turn you all of you in these similar situations!!! PLEASE HELP!!!! Thank you!!
 
You have any other issues. You are free to go. There is no conditions to remove nor others with your permanent residency, you are a LPR now. You just must remember your responsabilities of LPR as per www.uscis.gov

You can travel freely just that if you travel for periods longer than 6 months you will be breaking your continous residency in the case that you want to apply for citizenship later on. If you are going to stay outside the US for more than a year you need a Re-entry permit to re-enter the US so your status does not be consider abandon.

There is no law that says that you cannot fire your lawyer, is a person that you hire for a period of time and to get a service, but as everything you probably signed a contract and better check out the little letters. If you own him then you must pay him, the method of payments are something between you and your lawyer. I would recommend you that check out again the contract that you signed.
 
Yes you can fire your lawyer at any time. Bad example, but a good one at the same time, Michael Jackson fired his million-dollar lawyer for no reason.

In your case, you should review your contract (the retainer you signed to "retain" the lawyer's service regarding payment methods and timeline). If he violates the contract, then you can fire him AND not pay him because he breached the contract. At the same time, you can file a complaint to AILA [assuming he is a member of AILA] (American Immigration Lawyers Association) and your state (because he needs to pass the bar exam to practice).

Overstaying then get married should get you amnesty (I love that word nowadays). But don't quote me. I remember reading something like that on this forum and on USCIS.gov. Do a search on this forum for USCIS SOP (standard operating procedures). You should fine the manual and read up about the issue. BUT I think you are fine with your 10-year GC. You will get it and you will be worry-free for this immigration hassle from then on.

Thank you very much for your help. And i was looking over the paperwork that my lawyer gave me and i did not sign anything! All i have is a reciept with the down payment amount on it! So i think im safe to go ahead and fire him!!! Thanks again for all your help and good luck to the rest of you!!!
