10 cases got RFE today.!!!!

Guys:

on 06/08/2004 i found 11 cases had "Last date updated" to 06/08/2004 .

today morning at 10.01 AM among these 11 cases 10 of them got RFE.

all these 11 application receipt date are EAC040195####!!!!!!

my I140 is still untouchable for officers. :( .

is your application Labor sub?

My notice dt is EAC040115XXXX. I randomly was monitoring 10 cases. Out of 10, 7 got approved and only 3 reamining. I presume all the 3 are either Labor sub or catchup-concurrent or non-concurrent? . Mine is Labor sub and catchup-concurrent.

I like the expression - catchup-concurrent. Perhaps dashDurai saw Ketchup concurrents! :)

Yes mine is Labor sub.

However i found a bunch of Labor sub cases got approved.. my strong suspect is that my lawyer have made three mistakes.

one: he missed 2 pages of my my ETA-750 A & B form.

two: he mentioned my passed out year of degree as 1999 instead of 1998 ( this mis-leads the officer to conclude that i am not qualified for that labor).

three: he missed some of my old h1b1 transfered i-797 papers..

so my application is a mess. let me see what officer decides.

i can't do anything except waiting with deep breath.

In that case I will suggest keep copies of documents. Most likely you will get a do-able RFE.

I guess you should have asked to withdraw and reapply when you came to know about it. But now wait for RFE. I guess you have time left on H1b visa.
 
Labour Substitute Cases.

Hi Dashdurai and JSP

My case is also a labour substitute one.It was filed as a Concurrent on April 15th '04.

JSP you mean to say Labour Substitute cases are adjudicated later then the Regular ones?

As per my info the labour Cases are treated differently in that there are Special Officers with more exp who process and decide these.

Two of my friends in fact got their I-140's(EB 3's) approved in less then Four months.

Do the other Forum members have any info on similar/different lines?
