THANKS nj_skm, But just to clarify. My OLD EB3 I-140 is approved. However, I havent started the processing of my EB2 application yet so my Eb2 i-140 is not approved yet. However, i hope what u r saying is true & my case is not covered under Lc substitution since I'm starting a NEW EB2 PERM.

No. the reason I'm moving to EB2 is because if I'm able to use the OLD EB3 PD, then I'll come out of retrogression as my EB3 PD is June '02 & currently EB2 cut-off date is Jan03
