You missed the most important factor that influences FIFO. "Distance between the box containing your case and the certifying officer's desk." Like Saknia mentioned a couple of days back it looks like they have multiple threads of processing started by opening multiple boxes randomly..

I think svetac is right.Once you I-140 is approved then the labor becomes yours.Until then the employer has the right to use it for someone else.

You HR should have control over your Labor application..meaning they should have done the paperwork so that PBEC starts communicating to the new attorney.Your labor application belongs to your company and not to the attorney.Make sure you get an official coomunication from your company explaning...

Saknia's "RandomBox" theory seems to be the one followed by PBEC and thats the reason PBEC is ashamed of explaining the FIFO clearly.They make some smart a** explanations published once in a while to keep us shut.

Are u sure ? Some of the certified cases in the tracker don't even seem to have a 45-day letter.
