Sorry, I didn't realize you were from India, I just assumed rest-of-the-world. May be you'd be better off refiling EB2 then.

Your PD is now current, look at May visa bulletin, so there's no need to refile any more. You can adjust status now, and it shouldn't be too long if your I-140 has been approved. Good luck!

Shading, If the job conditions are different then you will not be able to keep your PD. In that case, in my opinion I think it's better to just wait for your LC from BEC, remember the backlog will be eliminated in September of this year, only 7 more months.

Kam,Prezcalvin, Keeping your PD is not just a chance that may or may not happen. If you refile for the exact same job (same requirements, same job description, etc.), and a job order has not been placed, then YOU WILL keep your PD for sure. That is what the law says. I did refile and got my LC...

Do not refile Why do you want to refile? Your LC has been certified and you have filed I-140. Also, your PD is in the current month, current PD for EB3 is 1/8/2002. Once your PD falls in the current PD for EB3 you can file Adjustment of Status, you're almost there.
