No I 94 with H1 approval notice!!!!
you may take the wrong copy. I remembered that INS issued 2 copies of I797. One is for the company without I94. the other is for the applicant. My company took the wrong copy when I got H1B.- bindu2006

When the first time I entered US in 2000, I had H4 visa which was valid for 3 months and my husband's H1B I797 Approval Notice which was going to be expired in 2002.
