Okay...let me make my question simpler... Does it make the dependednt visa holder out of status if there is a gap in applying H4 and applying H1? My employer did not file my wife's H4 while applying my H1 and delayed it by 1.5 months...does that make my wife out of status? Help...

Joe I also wish to explore the possibility of opening a Company with one of my friend and we both are on H1 visa. So you mean we cannot open a company unless one of us is a GC holder or a US citizen? :confused: I would really appreciate your response. Thanks Bobby
