Do vacations break the 7 years continuous residency requirements for the 212H waiver , If you are short 1 week out of the 7 year term , can you still use the 212 H ?

Why would you even worry about a traffic ticket ? I get so confused when I see this ! Does the INS really care if you get traffic tickets ?

A small update on this We will try to Vacate and probably do the 212H . We have contacted many lawyers and it will cost upwards of $10,000

Rick he couldn't be reached , left a message for him to contact us :-) After doing a ton of reading and talking to others , right now it looks like the 212H is the best . I hope he will call back . Also we will have the hearings moved to Miami as Orlando is 5 hours from us .

I belive the last conviction was a year ago " Tresspassing " maybe its been too long ? I'm not sure how long she was banned from the store , but went back years later and somehow they reconized her. How many years do you have to vacate ?

We Email an Attorney and he pretty much told us the same thing , and the Judge did not inform her of any immigrations that could be a problem in the future , so I belive this may work .

Since the INS already knows of these charges , why would it help to get them withdrawn ?
