    1) Does this means I will get my passport stamped if I go to local INS office listed above? Yes! 2) Do I need make an appointment? Based on the information in my approval notice, it sounds that I don't need make an appointment. Is that right? If I need make an appointment, should I call...

Exile_2001 They approved my spouse same day August 6th. Her fingerprint approval arrived a day later on the 7th. Figure that out! Funnily enough I have obeyed the green card rules to the day. It is for a future job offer. So (by utter chance) I was approved Friday and restarted at my...

I will have to look that theory up! It just depends if your case officer checks the case for the fingerprint approval weekly or whenever they feel like it. I hope the no mandatory RFE policy holds up for all of you guys. Given my recent employment dramas, I would have had to wait a further...

BTW My fingerprints were 21st July, I am mixing it up with my spouse. Cheers! I am sure you will be very soon. Most of my friends who have been approved were about 2-3 weeks after their 2nd FP. I mentally allowed for 2 months after the fingerprinting so as not to be disappointed. It all...

    I485/I140 withdrawl

This is what happens when you go away for Christmas and swear to never give a toss about the green card process anymore. Somebody asks you a question directly and you aren't there to answer it. My apologies, Ncintu. The answer is Yes. I speak from personal experience. I got my I-140 approved...

    Question on Job Change

Not quite true. There is no specific form or format for AC21. At its most basic you will have to supply an EVL from you new sponsor stating they are offering future employment with a list of job responsibilities, salary and preferably O-NET or DOT code. My attorney also wants to send...

    Question on Job Change

It is in your own interest to supply your address change to the service center because otherwise they never get your latest address. Which is kind of necessary if they send information directly to you. It causes all sorts of problems for both parties if you do not keep them updated.

Please advise - what should I do?

You will need to decide whether to be upfront with them. All you need from them is an EVL stating you are working for them now and they intend to continue employing you in the future. Covers all the options and you won't need another letter from them. How you get them to do that is the tricky...

In my case, the attorney has always drafted the EVL and emailed it to HR to print on company letterhead paper and sign.

    Joining Bankrupted Company

If it is a well known company, you will be fine. I was at a large company that has made millions of dollars losses every year! No problem as far as USCIS is concerned, H1Bs and I-140s straight thru. But if I move to a startup that is not making a loss but not showing a huge profit my I-485...

    Joining Bankrupted Company

The USCIS will not even know about the layoffs and anyway it is ability to pay you that counts and that your job is "permanent", not whether the company is restructuring (firing people) or rightsizing (firing people) or even repositioning itself in the market (firing people).

    I485/I140 withdrawl

If they revoke your I-140 before six months of your I-485 process, you cannot AC21. They cannot revoke your I-485, but can fatally injure it by above before that 180 days. We need a few more details, like are you working for them now and are they intending to fire you, or are you intending...

Please advise - what should I do?

Who is the I-140 approved for, A or B? If it is B, simply AC21 to A which will require a future employment letter offer from them.

    Green card related legal issue

I wholeheartedly agree. You are also expected by the USCIS to remain with your sponsoring employer for at least 6-12 months after approval. Otherwise, if your employer reports you left, you may have your green card revoked. And AC21 does not apply after approval. Personally I would not sign...
