1] What did your attorney say ?
2] Is there a procedure for amending the petition without affecting the Notified Date (priority date) ? or Is it going to be treated as a new filing ?
3] Is your attorney planning to (a) reply to RFE and request for the amendment at the same time...

Did your attorney suggested you to AMEND the pending (RFE) petition to EB3. Is it possible to change the category now without loosing the ND (Priority Date)... ?
RSeth:
Revised Experience Letters indicating "Progressive" experience is a good thing. Apart from that, I would strongly suggest you to take some "Reference Letters" from collegues, direct / indirect bosses, industry experts (or whom ever you can claim as expert.. for ex., a doctorate scholor...
RSeth..
I am sorry to hear about your RFE. But sounds to me like.. you have fairly good chance of getting approval.
You might want to explore on getting some new experience letters from employers and some Reference Letters from your ex-collegues etc..
It is scary to me as well. I am BE (E...

Yes. My attorney contacted CIS yesterday. She was informed that they could not access any information from NSC because of some network problems. So., they could not give any reason for the delay. But., they have opened up an Enquiry for the status on this case. Similar to yours.. It...

There is some missing information in my above posting.
You and Your attorney would need to file your I-485 and request the service center to convert your case to AOS. If your case is still pending, the conversion is immediate.

I am not exactly sure... But., this is what I think is correct..
It depends on if your case is already sent to NVC or not. Typically, if you have chosen CP option in I-140, after the I-140 is Approved, CIS service center would send your case to NVC for further processing. If it is...

I don't think there is difference between Non-concurrent and CP option as far as the processing time is concerned with.
When I was preparing to apply for I-140 (May '03), it used to be 2 to 3 months for EB2 and 3 to 4 months for EB3 at NSC. I have observed that for long time. Now...

If you want to go CP route,
1] make sure your employer can provide you all the doc's necessary for you.
2] Employment Offer Letter should be notarized.
3] You should be prepared to visit Embassy in foreign country (India, Chennai in my case) at a short notice.
EB2/EB3.. I have...

Mine is EB2-CP ND/RD: Jun 11th '03.
My attorney convinced me that way. I am in a similar situation as Naanshi is in. I need to see my I-140 approved latest by the end of March. I am really worried.. Bachelor of Engg with 8 yrs of experience. This I-140 is filed on a future employer...
Hi Naanshi
Please predict and wish something good on my case. I have observed that most of your predictions were proven right.
RIR - EB2 - CP - ND : Jun 11th 2003. BE + 8 yrs experience.
Thanks,

EB2 is NOT faster than EB3.. Also, it looks like there are additional risks involved with EB2 like..
Are you an Advanced Degree holder ?
Is the Advanced Degree really required for the job offered ?
Are all the other employees in that organization with similar job titles Advaned...

I share the same frustration. I simply don't understand why EB2 CP / Non-concurrent should lag behind by so much. I do have some time and other constraints.. like current H1 getting expired on July 31st. From that date, I have 5 more months to complete six years period. GC sponsoror is...
