    Whoever gave you that information is wrong. You DO need to pay 1000 penalty fee for ANYONE filing under the 245i.

    They did ask me where I was at the time of or before 2001. I had my highschool transcripts to show them plus they had a copy of it in thier file. It really depends on the officer. I would rather have all the documents ready instead of them telling you to bring it back.

    I was under this as well. Make sure you bring documents showing where you were at the time of or before 2001. Make sure you also have proof of the person who petitioned for you before 2001.

    You just need to show what type of status they have here in the US. You also need to include income that is 125% over poverty level. I think the most recent or 2008 tax return should be fine. Good Luck!
