USC's parent for CP. Previous COS denial and out of status. Please advise.

Just wanted to provide an update on our case so that someone in a similar situation could benefit. My father's consulate interview was a success and he received an immigrant visa. The CO did ask to see the R1 visa filing and the final decision letter to verify that the extended stay in the US...

USC's Parent for Consular Processing (immigrant visa) Hi Rajiv! Case info: My father's I-130 is approved (IR5) and case is currently with NVC. Father has visited US 3 times (10 year visitor visa). On his 3rd visit (in 2008) he filed for change of status (B2 to R1), sponsored by a local temple...

USC's parent for CP. Previous COS denial and out of status. Please advise.

Triple Citizen, I think you are wrong. I have gone through several credible websites, including those that show actual INS/USCIS memos that talk about presence in the US while COS/EOS is pending, and all confirm that one is in "authorized period of stay" while EOS/COS is pending provided certain...

USC's parent for CP. Previous COS denial and out of status. Please advise.

TheRealCanadian, thanks again for your response. Given all the facts of the case and the applicable laws, I do expect the consulate to issue a visa. But you just never know. I'm so paranoid! Sometimes I feel the US immigration law is harsh on those who follow the rules than on those who play...

USC's parent for CP. Previous COS denial and out of status. Please advise.

VisaNutz, thanks for those links. I had read those (on different sites though) earlier and that's why I'm pretty sure that my father's stay beyond I-94 expiration, while his COS app was pending, was a "period of authorized stay" and would not count towards unlawful presence. I believe he meets...

USC's parent for CP. Previous COS denial and out of status. Please advise.

It was not a frivolous application and it was also not denied by USCIS as being frivolous. The denial letter stated that the sponsoring organization did not meet certain criteria (something related to organization's filing classification). Like I said earlier, the attorney who filed the...

USC's parent for CP. Previous COS denial and out of status. Please advise.

TheRealCanadian, thank you! Yes, my father departed from US the very next day after we got the USCIS's decision in email from the attorney....9 days from the date on USCIS's letter, to be precise. So it's good to know that that won't be a problem. Just curious...is there an appeal process at...

USC's parent for CP. Previous COS denial and out of status. Please advise.

I became a USC last year and recently got my father's I-130 approved for Consular Processing. The case is now being processed at NVC. I'm a little concerned about the US consulate denying him a visa for the following: My father has a 10 year multiple entry B2 (visitor) visa, and has visited...

    Question about Oath

@sirus - Thanks. No idea what's special about the Oath ceremony that I'm "selected" for. I'm not changing my name or anything. I have had to wait for almost 3 months between interview and Oath. It's not a big deal, it's just seems longer than the norm. I'd have been much happier to just get it...

    Question about Oath

Update I finally received my Oath letter last Saturday. Yay! I'm scheduled for Oath on Sep 23. The letter says "You have been selected to be part of a very special naturalization ceremony being conducted at..............". That might explain why they took so long to schedule my Oath...

    Question about Oath

Thanks Yes, my friend, I know I'm not in the worst possible situation, or even a difficult situation for that matter, that many folks unfortunately find themselves in, often for no good reason or explanation. I know I am fortunate that way to have gotten to this stage without much hiccups...

    Question about Oath

Does anyone know what happens at the DO between Interview and Oath? Here's the thing...I was interviewed at the Denver DO on June 30th and passed the interview (received letter at the end that said recommended for approval) and was told that I would receive Oath letter in about 4-6 weeks...

Update Got done with my interview today. It was a pleasant experience. I was in and out in 5 minutes! It was super fast, almost unblievable. I had overprepared and therefore had tons of documentation with me but nothing was asked, just the driving license and PR card. I also had 2 speeding...
