Time to stand up against DOS and USCIS

I don't know why US should discriminate only Indians. Someone should sue USCIS for this pure discrimination and change the laws accordingly.

Bill to remove the per-country cap: a destroyer of EB3

Exactly. When US wants people from one country they should be willing to offer GC's based on their entry date or some other reason and not simply on country of birth. I have a PD prior to Jackolantern and he got his GC 8 months ago and I can't imagine any sooner. Won't you feel discriminated...

Bill to remove the per-country cap: a destroyer of EB3

US requiring people from one or two country during Y2K is selfishness. Later offering GC based on country cap is a discrimination. People enter US based on the requirement (Although I should agree it is based on emplyer too). But cap has to be there to restrict the country limits prior to...

    Legally Challenge per country limits

Country quota is a clear discrimination like OP said. Prior to coming to US they can discriminate but not after coming in. In fact country limits should be based on number of visas issued or number of GC's applied.

    8th Year H1b and H4 Extension

You can have I-94 within US. You can't file extension for a person who doesn't live here. So the simple answer is you just file your H1 and send your H1 copies for your wife & kids to get a visa stamping to enter US.

    Pros and Cons of C-corporation

You start a business with IRS and as per IRS we all are residents (as per presense test). IRS won't even understand the CIS regulations.

How do we tell CIS that a person is on EAD (own a business) instead of H4?

    Pros and Cons of C-corporation

Lot of people forget that there are two different entities in US for immigrants. One is CIS & IRS. Paychecks, Credit Cards, Bank Accounts, IRA's, 401K's, Businesses and lot more come under IRS regulations. I saw a lot of places in this business forum giving wrong information about starting an...

    LUD after FP Done??

TSC is processing any application faster but NSC really sucks. Now I can estimate how many years it will take for them (Only NSC) to get my GC even if the dates are current in future. NSC SUCKS. Better luck next life.

Travel on AP to get married

My attorney said that using AP invalidates H1. Keep your AP with you and try to play a safe game by getting H1 stamping with along H4. H4 stamping alone may lead to lot of queries by consulates. Worst case if your H1 is rejected you can still come back with your AP.

    Address change while petition pending

You have to fill Change of address form at USPS first. Change of address is valid for 1 year. But these Government related envelopes may contain "Return Service Requested" meaning if the person is not available in the current address it has to be returned and not forwarded to the new address. IT...

    I don't understand?

pswami is 1000% right. I have seen a lot of people who said that they want to leave US in 6 months or 1 year. They will repeat the same but stay for ever and apply for GC and so on. GC (or even PD) has unlimited potential whereas pay raise is short term only.
