First of all, what was the crime? Also, how long was the probation? If it's post IIRIRA, it has to actual incarceration (St.Cyr vs INS) where person is actually locked up for 5 years to be defined aggravated felony. Post IIRIRA, even probations are considered as "actual" sentencing so 1 year...
It all depends on how fast proper paper works are filed. I know a case where it took 14months for someone to be deported back to their country back in 1997. He was in jail the whole 14months.
X2. Very accurate information. Since OP's brother was not incarcerated for 365 days or more, less likely he'll be deported. INS can not stick the aggravated felony tag on him. But like dafortycal stated that i this is his second CIMT, he is vulnerable to deportation.

I had my bio-metrics done for I-90 on 10/20/2006 but green card has not still arrived yet and today is 12/06/2006. I've never seen NBC who suppose to help us have inadequate information on our case to do so. It's really frustuating.
