Provided your PD or EB1 is current in June, you can file for I 485 without the approval of I 140. That is called concurrent filing.
You can file EAD/AP/485 together for you and your derivative i.e. spouse.
I hope you are aware that USCIS does not counts the backlogs due to retrogression as their own.

However, to be on safer side of the law, in the instance your I 140 is denied, then you may want to be on status, for which you need H1 after your expiration of OPT.
