My spouse has completed 6 years on H4, My labor is still pending so working on EAD is out of question for some time(God know when this time will come :( ) My question is can I apply for H1 for my spouse as she has completed 6 years on H4.

your lawyer should put proper case explaining, 6 year is expiring on 06/2006. it is not normal but in some cases it may possible uscis has given extra stay, but it is your responsibility to apply for 7 year extension. ask your lawyer to submit case with all docs(passport/old h1 copies) and...

Jasukira , thanks for your reply , now it's been 9 week i sent reply to REF and not heard any thing from USCIS. so kinda worry what's going on. normally most of the applicant got response withing 8 week after REF.... any way hoping for quick response, keep update about your case.

USCIS received REF reply on Spet. 21 , I've not heard any thing after that. any idea how much time uscis take to update case after REF documents received.
