If your country of birth is India, then no. Else yes. EB2 India will remain retrogressed for some time. With a March 2005 PD, you may become eligible to file I-485 in 2008-2009.
I think you should consult with a better lawyer. My read on this is that your EB3 140 will also be denied since your labor does not allow for combination of education credentials. An appeal however may buy you more time incase they are looking at the I140 status and deny your H1 extension based...
call her again and tell her about your plan B. you will go back home and open a call center that specializes in status reporting of BEC cases and have her job outsourced.

if your priority date is 15 november 2002 and yours was a RIR case, then your case should not have gone to dallas. i know for sure that december 2002 RIR cases were handled at SFO DOL and they received their labor certifications around...
your 45 day letter is from Dallas BEC right? there was some speculation that some WA cases were in Philly. I'm hoping that is not true. Despite Dallas being this chaotic, I think they are more efficient. Philly is bad news cuz they appear to be very slow from whatever I've been reading.
not heard anything (so what's new about that) ... i'm considering asking my company if they are going to consider converting the old appliction into PERM. i believe the filing + processing time for EB2 RIR PERM conversions is a little over 6 months. if this BEC pile of crap had not happened...
