Do I have chances of getting a green card? Please, any advice is appreciated!

Thankful, I think if he was charged with "smugggling" (212 (a)(6)(E)) USCIS should have started removal proceeding against him already. I suspect he was charged with something else....

Greencard Category is subject of persecution by COP officials

I would have to assume that most of the participants on this forum were persecuted, at least in the past. If you are such a happy citizen of China, maybe it is about time that you go back. U.S. does not accept economic asylees.

I just do not understand his concern. United States is not obligated to protect non-citizens in foreign countries. Quote me the section of the law otherwise; I just believe this is totally frivolous complaint.

    Asylee problem, please help

AS8 category should be perfectly fine, although AS7 category may get some issues, especially in the original asylum application the principal asylee mentioned about the persecution to both the principal and his spouse. Therefore AS7 category's visit may appear to be a little inconsistent with...

Is traffic violation affect your AOS

You should seriously consider suing them. You do not even need a lawyer; you can sue them pro se. No one asks them to process every case strictly in chrnological order, but quite a few of those cases got delayed and approved right after WOM case was filed. This is purely ridiculous.

Agree, except for asylee the "re-avail" term is still an issue. This is clearly stated so in INA, by the way.

Incorrect. That is NOT what they said. Asylum status may be terminated for specific reasons as listed in INA § 208(c)(2). An individual’s underlying asylum status may be terminated even if the individual has already become a lawful permanent resident. Accordingly, an asylee or a lawful...

Incorrect. Someone here posted USCIS Operating Manual as of November 2007. (Good job, as I do not have to download and upload): http://forums.immigration.com/showthread.php?t=250055&page=3 On page 143 last paragraph: Termination proceedings can only be initiated after an Asylum Approval has...

Do I have chances of getting a green card? Please, any advice is appreciated!

Go get the disposition letter, usually they will ask you for a small fee. You will need it anyway in the interview. Get the original one with the Court's seal. In the disposition letter, they will list the section of the law you have violated. Do some research or ask an attorney how serious...

I don't think in your situation there is an issue. Get enough documentation and you should be fine. From the background of cases I know so far, in everyone of those cases those LPRs did seem to have "abused the system". So far, USCIS routinely grant AOS to asylee without looking at the...

Eljay, First of all, do not go personal. I used to be an asylee, and I am now USC. However, I have been always an asylum-seeker advocate; that position has not changed, ever. Do I think asylee-turned LPR has dual status? Obviously, USCIS thinks so; I don't. That said, it is important...

Go to any law school's case database and search for "Sikh" under immigration. Hopefully you will be able to browse through to find the case because I do not think there are a lot Sikhs in U.S. The guy is from Sikkim state of India - that is probably all I can remember. Of course the defendant...

Well, The USCIS' position is that when asylees adjust their status, the law (INA) does not expressly say that the asylee status is terminated. If asylee status is not expressly terminated, the asylee, once adjusted, still has the underlying asylee status. His LPR status is only derived from...

The easiest way to look at this is to read some of the precendential decision by Circuit Courts. Courts held that "being able to obtain identification documents alone does NOT, by itself, constitutes an adverse credibility finding of the petitioner's claim of persecution", as the "no evidence...

Do I have chances of getting a green card? Please, any advice is appreciated!

First of all, if you were arrested, when they fingerprint you, they will always find out. Therefore, it does not matter how long you wait. Secondly, they will not deny your I-485 application without interviewing you. So, you have at least one year to find an attorney, if that is really...
