    Re: EB2/EB3 Actually I didnt think that it mattered for labor, whether you file EB2 or EB3. As far as I've seen, For Labor : It only matters whether you've filed as RIR or non-RIR (not if it's EB2/3) For I-140: It only matters whether you've filed EB1/2/3 (not if it's RIR or non-RIR).

    minesw, I know that in general the application priority date will remain the same (ie. the PD for the RIR petition) when moved from RIR to non-RIR, so one does not lose the initial place in the labor Queue. This also probably means his company will have to put out ads as per SESA's...

    I would say apply for your I-485 ASAP. This way, you'll start the 6-month clock on the 485 right away, and hopefully you will be able to stick around in your current company for that time. Meanwhile, since your I-140 has been in for a year , there is a good chance it might get approved real...

    Yes, I think it matters. Both DOL and SESA generally process RIR applications faster than non-RIR. You can check this trend out if you look at the Boston (and even other) DOL processing times for RIR vs non-RIR. For eg. the current Boston DOL processing date for RIR is Jan 2004 and for non-RIRs...

    Congratulations, bronxboy! Good luck with I140/485. That means RIRs are currently taking a month or so for approval... So, it's not surprising if the non-RIRs take 2 months (or more?), I guess.

    Remember, it is very likely that most of these 70-odd cases from Jan/Feb 2004 are Nurses and Multi-national executives (the USCIS processing dates for these are around Jan/Feb 2004). I havent checked out the details of cases processed at immigrationwatch.com myself...does it mention the category...

    ST, It is definitely taking more time than it was a few months ago (you caught the crest, I think!!). Tigris : 3-6 weeks is what the DOL rep. told me on the phone.
