I am still waiting to hear on my RFE as well. It's been around 6 weeks since they received my response, and no word after the couple of LUDs right after they received response.

Pallu2004 - Yes, I think approving I-140 before approving pending EAD/APs appears to be a general trend in the forum in the cases of RFEs. However, note that my EAD2 was renewed several weeks AFTER they issued I-140 RFE. So, with USCIS, you never know :rolleyes:

My RFE response was received on 3/31, and LUD changes occured on 3/31, 4/1 and 4/4. After that it's been abso quiet. LSaspirant - looks like we fall in the same time line. Patiently waiting.

I did get an LUD on I-485 as well. However, I also sent in an AR-11 (address change), which was entered into their system presumably around the same time my RFE was issued. So, it's hard to link the LUD changes one way or the other.
I've seen trends where the RFE typically is...

Just an update - my RFE is for ability to pay. Company's tax returns need to be submitted. I am hoping this will be straightforward since I have been getting the proferred wage from PD to date. Keeping fingers crossed...

Congratulations! Nice to see an EB-2 approval so quick. This might be a record approval, given your FP isnt done ;) One more piece of evidence that USCIS is treating 140s and 485s separately...
On the other hand, now that the concurrent adjudication memo has been thrown down the trash (or has it??!!), may be they'll work on approving the I-140s first before sending out FP notices? Either way, it would be good to see some movement for EB-2 cases from Apr '04 and later :)
Well, as far as the tracker goes, I dont think that USCIS has even STARTED giving FP notices for EB-2 filers past 3/31/04...so the issue of them having STOPPED FP2 doesnt arise I think ;) Fom the 2003 tracker it seems like there are a significant number of 2003 filers who have themselves not...
