Our 485 is not yet approved and might take a long time as we are from retro country.

Correct me if I am wrong guys...
If you are out of status for some time .... and then you get a new H1b approved .. all your past wrongdoing ( not the correct word) is pardoned.
The logic is that if someone goes out of status .. a fresh H1b should not be issued .. and if it is...
I think there has been a gross mistake in filing your I-140... and possibly even the labor application.
Some coloumns about Ur company is wrongly entered .. and that has generated so much of Queries.
I suggest before answering the RFE .. you have to go thru the application that Ur attoney...

it's not vague.. Getting lower wages does not automatically flag Ur application for RFE..
If the company (assuming that its small company) tax returns are good for the year in which Ur labor was filed -- then U are all set...
But since the labor is taking such a long time --...
Tax returns.
The tax returns which U submited with I-140 does not look good... Ur attorney made a mistake by submitting it. It was a sure flag for RFE.
Now how is the company doing in 2004 tax returns.. If it is better looking then U can submit that for ablity to pay issue .. Shows that...
I would say 40:60 chance of approval.
The chances are 40-60. -- More likely you will also get an RFE -- actually there is a flag which sets in on the company typically for 'ablity to pay issue'.
The chances of getting approved imporves if :
1> There is change in companys' income since...

Check your name in I-140,485 and all the documents U sent (passport,degree etc .. They should all have the same name..
If the name is incorrect -- send the actual name -- with some proof..
U will get approved within a month ..

Well it was little lucky for me -- I got my H1b extension approved today.. I had an RFE on it -- Ablity to pay... submited companies tax returns etc.

If your company is paying go for it -- else I really do not see any reason to do an H1b extension.
1> 485 denial are very rare.
2> If you have H1b extended and 485 denied then next what -- if you plan to move back U will get just few more months on H1b-- and U cannot do a new GC processing...

Are U from Manglore --- great place -- I do not know what the police guys look like over there -- but I guess it should be better than most the places around.
What about using AC21 and joining some other company ? Just an idea...
