I got the same response from FBI (i.e. name check is pending since July 2006). So far, no movement at the USCIS side, despite the memo. Now, I am in doubt - should I go ahead and sue them using the FBI response and memo, or just sit tight (for how long?) and wait?

Thanks for update! I wrote to FL in November, so now I have at least a hope there will be a reply in a couple of months. Meanwhile, both Senators replied - both with the same message: FBI name check is pending. Now, let's see whether FL penetrates the FBI.
