Retrogression + security check, that is the main reason.
Myself marching into 1 year of I-485 although PD was current for some
months. I have friends from India who are stuck for 1 year , 2 year etc. ( PD current for most of time ).
Those who mostly complain about 'stuck' in security checks...
Isn't the fee hike and no fee EAD/AP scheme from July 1, 2007 onwards.
USCIS still has the chance to make much from those going to get stuck in the process ( more than the amount that would get if the folks applied in new fee scheme )
I was wondering whether "being processed" means
1. Just sitting on their shelves for an officer to look at the namehits.
OR
2. AN officer is looking to the namehits and being processed.
How frustrating this is.. Don't they...
Yeah, i am starting the process.
And i am more hopeful of receiving letter from FBI ( to possibly clear any communication gaps between FBI & USCIS ) , then who knows other miracles
might happen.
A pessimist here.
All these cases reported clearing namecheck with FL intervention are within 1 year / around 1 year of I-485 cases. I was wondering , say a case with 2 - 3 years pending namecheck cleared with FL intervention ?
But i do agree there may be no harm just trying this route.
Looks similar to my case. My labor rotted in Phily BEC and now started rotting
at TSC with namecheck blackhole. I applied I-485 in July 2006. I had LUD in Aug.206 after FP. After that nothing. A service request recently ( as latest as last month ) got me a letter from TSC that i am stuck in...
hello hudakchullu ,
Is there a way to know from FBI at what stage of security check you are stuck ? It seems there are two stages, afte the name is "hit".
1. All "hit" applications wait for an officer to look into them
2. The actual investigation is going on
I guess since you waited...
If one is from India ( i don't think it is racial discrimination ) there are high chances of getting stuck in namecheck. This is based on my observation in forums , neighbors, workplace buddies.
Now June started, there will be a flood of applications from Indians and i think i will get a...

Freedom of Information and Privacy Act (FOIPA) vs. Name Check: Freedom of Information and Privacy Acts (FOIPA) requests are sometimes confused with name check requests. FOIPA provides copies of FBI files relevant to a specific FOIPA...
I recently asked similar question to my paralegal and reply was i can go and come back on AP. It doesn't invalidate the H1. As long as EAD not used one is in dual status : h1 + 'AOS applicant' . You should ask these kind of questions to an immigration attorney , to get the correct answer.
Applied on April 12,2007 Waiting
I don't know what complex processing is being done. This is the second EAD.
I am with same employer etc. Why should they take that much time ?!
