    7th year H1B can be filed if you filed labor petition or I-140 petition or I-485 petition was filed 365 days prior to the expiry of 6 year of H1B, then you are eligible to apply 7th year H1B. Also you have to file for separate H4 for all your dependents. Check H1B forum for further details.

    It's not fraud , it's just processing delay. These days everyone wait around 6 to 7 moths for EAD and AP. All these hardships are caused due to backlog of immigration benefits applications at CIS. I'm not aware of any lawsuit against CIS for fraud. It's looks like you are more serious, so...
