EB2 India and China have retrogressed by 2 and 3 years... Others kept moving a little bit.

EB2 India: 01JAN02

bigbang, you're right. I found this note in the article - "The employer has an obligation to notify the Immigration and Naturalization Service ("INS") of the termination":

However, the...
A leave with small amounts being paid from severance package is probably the best.
However, I think csrini1 should talk to a good lawyer, in addition to listening to a somewhat knowledgeable group of engineers and others over here.
Speaking about company notifying about H1B job...

FBI namechecks in other countries
I've received a package from Senator (Mike Honda), asking me to provide info on application, and sign release form.
What's is intersting is their letter explaining nature of FBI namecheck delays. What they say is - "before a name check is completed, it may...
1. No fairness in NC process. Many come out fast (several days to 6 months), and usually they would not visit this forum. Others seems to resolve without any particular order (1 to 4 years)
2. Read the forum. The only easy and reliable way to find about NC is by going to Infopass appointment...
Contacting congressman's office
I sent an email to my congressman's office through their Web site. 4 weeks passed, no reply. So, I called them, and found out that it takes "several" months (!!!) to get a response to email, while regular mail gets a response within days.
Make sure to use...
This tax-related text dated July 17, 2007, page 55 has some explanations on USCIS and FBI NNCPS. They say some other agency did provide contractors to FBI a year ago, which helped reducing 70% of that agency's-related backlogs. Now, they're saying FBI and USCIS are working on a similar strategy...
This is NNCPS (National Name Check Program Section), headed by its Section Chief Michael A. Cannon. I think NNCPS belongs to Records Management Division.
Will be interesting to see you getting that printout. Your friend could get into deep trouble for releasing FBI documents without going...
In other forums, I saw that namecheck gives you a status like "investigation into your background remains open". "Under review" usually meant that your case is in the queue for adjudication (still may take several months). I hope it resolves soon!
No wonder. When I sent a service request for my wife (depndent applicant) in May, USCIS replied that her namecheck is still pending. When I went for Infopass two weeks later, they told me her namecheck has cleared. Go figure... As we say in Russia, their left hand does not know what their right...
Would this work now before October, given that all EB categories are Unavailable? Wouldn't they simply tell that "no approvals can be given at this time" and accordingly do nothing with your request? Who would look at FBI slowness while USCIS doesn't have to approve anything anyway?
I think we all agree that filing WOM delays others somewhat. But what should we do? Just let FBI keep their status quo, where nothing gets fixed and nobody is held accountable?
Waiting_aos, I don't know details about my friend's case, will find out later. But you could do a research on the...
My friend has received his GC after waiting for 3 years and then filing WOM in the Federal Court here in CA. I'm waiting for "just" 1 year and 2 months... way long before I can file WOM... but the preparation starts now. I do not want to just wait.
I think any people receiving approvals dated in July should consult with their lawyers before really using GC for a job change, travel or anything. Send a letter to immigration-law.com as well, may be they will post an answer for everybody's benefit. There were cases when GC would get revoked...
There were two documents relating to this.
1. Testimony of MICHAEL J. MAXWELL:
In order for the FDNS to appropriately oversee the IBIS National Security/Terrorism-related hit resolution process, and also acquire significant data relevant to the background check process, it has been...
Once FBI namecheck is done and has positive results (they found some info about you) the case will be sent for review to FDNS (Fraud Detection and National Security) unit within USCIS. It's USCIS, not FBI unit. FDNS has to review namecheck results before adjudication can continue.
