Continued Residency - Question for me and my family.

You can't apply for reentry permits unless you are in the USA. A green card alone is no longer valid for entry after you are outside the USA for more than one continuous year. It is highly, highly recommended (almost mandatory) for your family members to return to the USA before one year abroad...

Doubts about becoming US Citizen because expats taxation

It's FATCA, not FACTA. I don't know about Europe, but here in Canada the banks know US law and are happy to do business with Americans.

Denial of naturalization due to lack of contious residence

We had a similar pattern of travel but flipped. We were mostly away from the US during the FIRST half of the statutory period, and entirely in the US during the second half. We also had no single trip longer than 170 days. We had no issues aside from a small delay in approval.

Decision can not be made due court dispassion letter and trips review

I think it was two months, it ended up being processed within the average timeline even after the delay.

They just need more analysis of your case. We had a similar thing and nothing bad happened. When we next heard from them, it was to schedule the oath ceremony.

Green Card Received - Delay in Transfer to Sponsoring Employer

You have your green card already. The fact that they previously sponsored your green card is irrelevant. You are now just like any other employee. Nothing they do will affect your green card or naturalization. But if you live outside the USA, for employment or any other reason, that will affect...

Denial of naturalization due to lack of contious residence

As far as I can tell, the law itself only states six months. USCIS regulations contain the 180-day cutoff (actually it is 181 days). Your trip lasted 182 days according to my date calculator. Unfortunately this one extra day is enough to make your case difficult. Instead of them having to prove...

    Sponsor and co-sponsor obligation

The agreement of support is a legal agreement between the government and the sponsors/co-sponsors. The husband cannot waive the agreement. But the husband can just avoid accepting public assistance to keep the government out of it.

Applying for citizenship/ divorce/ green card

It should be no problem. After 5 years your application stands on its own. They scrutinize your marriage when you petition for removal of conditions. You've already done that. If you were applying on the 3-year basis then it would be a problem.

    Sponsor and co-sponsor obligation

The government can successfully sue any or all sponsors or co-sponsors for repayment if the green card holder collects government benefits during the period of required sponsorship. Certain categories of benefits, such as unemployment compensation, are ignored for this purpose; see...

Denial of naturalization due to lack of contious residence

The 4 years + 1 day rule only applies to absences of 1 year or longer. You'll need to wait until 90 days before 09/10/2019.

Green Card Received - Delay in Transfer to Sponsoring Employer

    1. If you already have the green card, then you're not going to lose it unless you reside outside of the country, commit a serious crime, or committed fraud while applying for the card before you received it. Similar considerations apply to naturalization. 2, 3: That's up to you and your...

Parents with Green Card stayed outside US for 15 months and want to return back

As I understand it, a green card alone is not a valid entry document if you've been absent from the US for more than one continuous year. You can take your chances at the port of entry, but there are no guarantees. The worst case is that you would be denied entry and sent back, with the green...

Doubts about becoming US Citizen because expats taxation

You're wrong about this. The Foreign Earned Income Exclusion applies to regular income tax on self-employment income as long as you otherwise satisfy the requirements for using the exclusion. However, the exclusion does not apply to self-employment tax on self-employment income. You may be...

    Sponsor and co-sponsor obligation

The husband can sue the wife or co-sponsor for support if his income is less than 125% of the federal poverty guideline, which varies according to the number of children in his household (and is higher for Alaska and Hawaii). A single childless man making $10/hr full time would be over the 125%...

Renew Greencard or Apply for Citizenship

Your husband has only been a permanent resident for two years. Normally, at least three years are required to apply for citizenship. Also, a green card expiring after two years is not a "renewal". You have to petition for removal of conditions, which is a much more complicated process. Failure...

    Maintaining green card status

Hi ssbaf, regarding reentry permits, it's really easy to get the first one and to get a second one after that, but once you apply for your third or subsequent reentry permit, they start scrutinizing your application pretty hard to determine if you've abandoned your US residency.

Regular travel between alberta and Montana.

Canadians can visit the US for up to six months at a time. As long as you don't work in the US, and you're not inadmissible for some other reason (criminal convictions, etc.), you should be fine. There are lots of people who frequently commute across the border.

    Maintaining green card status

As a practical matter, it is extremely unwieldy to apply for citizenship if you're not in the US. You will have to fly back and forth for biometrics and interviews, and your recent travel history will be scrutinized leading to all sorts of awkward questions. Fortunately, the application process...

Maximum number of days outside US without obtaining for Reentry Permit

One small clarification: If you are absent from the USA for one year or longer, then there is a special rule (the "four years and one day" rule) which says you can (re-)apply for naturalization four years and one day after you return and re-establish residency. The four years and one day rule...
