I'd go by things like: how far is the border? Or, if I am already planning to visit home so I might as well apply for a new TN at the border on the way back.
I-129 is a rather simple form to fill out. Make sure they run it by you before submitting it. The key thing is the TN offer letter...
Make sure the lawyer includes your husband on I-129 for the renewal TN extension so he can also get his TD renewed. Also, I'm assuming you already know you cannot file I-485 until a decision has been made on the I-129 application.
However, my GC is not even 6 months old. How can I violate PR requirements in such a small window? The officer is not paying attention to the date of issuance of my GC? Doesn't they need at least a 12 month window to check for PR violations.
Also, is there anyone here who has traveled with GC...
Thanks Veggie3 for sharing your experience. So I am not alone :). It is a norm to be asked that question and your explanation makes more logical sense. This is the type of post I am looking for unlike replies like this: "Oh CBP has the right to ask you any questions and give you a full cavity...
I beg to differ. Yes I have traveled to the UK and a few EU countries numerous times. But I have a Canadian passport. So my experience might be different than yours especially when it comes to the UK. We are still a British Commonwealth country after all. In Germany, I was asked zero questions...
No rights were violated and I just want to know if this is a usual question from a GC holder. It has nothing to do with my ego. Remember I just got my GC and thought I got rid of this line of questionings about my career every time I cross the border. The questions that make more sense to ask a...
Egotistic?!! I think the CBP officer is being egotistic in this case. The more I think about it, the more I realise it is a stupid question on his part just because he does have access to my history on his computer screen.
He probably looked at my history and noticed the previous entries on...
There is nothing in the book that says if you're an unemployed GC holder, you'll be subject to deportation or revocation of your GC. Plus this is all out of a USCBP officer's hands anyway. Only an immigration judge can order a deportation or a revocation. Let's say hypothetically you have...
I recently received my GC thru EB-2. On my first trip to Canada, on the way back, the USCBP officer asked me what my job was to which I replied: "Electronics engineer and I still work for my GC sponsor if that's what you're inquisitive about." He did not say anything to that. I almost told him...
Nope. It doesn't work like that. If the TN mail application gets rejected, you'll be out of status and must leave the country. That's assuming you also apply for Change Of Status (COS) along with the TN application.
Any new status you apply for by mail keeps you in status until a decision is rendered. But you cannot leave the US while the application is pending or it becomes void.
The_Gift, I do not recommend filing for I-485 until your husband comes here and settles down for at least 60 days. There is an elevated level of scrutiny by the current administration and they will find any reason in the book to deny you. You can notice the extra scrutiny and the recent TN...
You got Trumped too!! Gees! My fellow Canadians, please be careful what you say at the border. Never provide extra information unless you are asked to. Educate yourself about TN pretty darn well before you go to the border to apply for TN. I'm telling you this new administration does not like...
In other words, you got trumped! Welcome to Trump's 'Murica! There'll be more and more scrutiny for everyone. Heck, even with a green card, last time I crossed the border, I was asked if I still worked for my sponsor!!! I wanted to give the CBP officer a smartarse answer but then I thought to...
If your husband is already in the US, then apply for I-485 yesterday. Why are you waiting? If you apply for 485, when his TD or whatever status he's on expires, his status automatically changes to "AOS Applicant". There is no need to apply for TD for him. I'm assuming he did not enter the US the...
It's called the 30/60 day rule:

I don't think The_Gift should apply for I-485 for her husband who is entering in Jan on the non-immigrant TD status. This shows the lawyer is not a good one unless The_Gift has not told the lawyer about...
You're cutting it a bit too thin. 3 months may not be enough these days to get an EAD/AP. I can see on other forums people's EAD/AP applications are taking a very long time these days. You cannot file the I-485/I-765/I-131 until your husband gets his TD, leaving you only 3 months. So be prepared...
I know it sucks :(
Were you forced to use your employer/sponsor's lawyer? I was and I didn't like it a bit. I wanted to hire Murthy law firm in DC and they charge almost half of Fragomen. Plus they have done so many WOM's that there is no way they make mistakes like this. The only problem with...
