I have question for all experts here...
I am planning to apply h1b at Calcutta, I fall under chennai. I was denied student visa in 98. Am I eligible to apply for H1 at calcutta? I am not geting any appointment in chennai and I have to go to US asap.
Yes..you should go to CP forum...I know Chennai accepts because I checked with them for my case few months back. Unfortunately my I 140 is struck because of Ohata ..let me know if you find out otherwise about chennai consulate.
congrats...now you can either go for Attroney certified consular processing (faster route to get GC) or wait for another 1 or 2 years for I 485 to get approved. Good luck
Naanshi...I know you are very helpful on this forum. But can I request you not to state that AC21 kicks in even if I 140 is not approved. Its kind of misleading and it might ruin someone's life. I know you believe AC21 is valid even if I 140 is not approved, but I have not seen any legal backing...

You don't get students loans till AOS. Either you should have co signatory or you are not elegible for studnet loan in many university. For students with GC, loan are given without co signatory.
from what I have seen from my friends I 140 approvals is that INS is processing I 140 CP or just I 140 filed cases. But not processing concurrently filed I 140. I don't have proof to back this but thats the case with few friends who filed I 140 same time. Lot of FP notice is going out for...
This is what I found, which make sense to me.

as they are accruing time toward the 180 days while the I-140 is pending, as long as it is finally approved."
That means if employer withdraw the application (i 140) after 180 days, AC 21 can't be used.
One more disadvantage of this present memo is attroney certified CP is not possible...

:mad: :mad: :mad: Looks like concurrent fillers are screwed by INS this time. I 140 will not be processed till I 485 is ready to be process, that means AC21 is thrown out of question. Also attroney certified route is also out. Seems to me it is one more way INS trying to delay whole GC process...
I hope Naashi is right :D and my I 140 and I 485 is approved same time.
