Thanks again for the information. As for the I-94 submission before departure, this is what my Lawyer was saying before.

I'm also in the same situation. My AOS was applied in August and I'm in my 9th year of H1B extension.
I'm planning a trip to India on Nov 19th and not sure if I should wait for my AP documents or get my H1b Visa stamped from the US consulate in India.

PD: 10/03
Converted to RIR: 12/06
Ma_nonrir_eb3, I checked with my new Manager and he is saying the company is at a risk if we go for the substitution. I don't understand why. I think the pre approved LC job description is a part of my originally filed job desc but is not an exact match. Both are for software Engineer. I have...
Congratulations Ma_nonrir_eb3. My PD is around the same time as yours. My Lawyer filed for RIR conversion in Dec 2006.DBEC is still showing as RIR-IN PROCESS. Now my Lawyer is saying that we have a LC Certified that I can use to fasten the process of getting GC. The Job description for the...
I just checked with my Lawyer, And they are saying that my case status is showing as RIR. I did not receive any email notifying me of the conversion. My conversion was filed on Dec 08th.
I don't have the info to check my case online. My Company say they cannot disclose this information. I have to wait for Lawyers to inform me of any progress .
Conversion from Non-RIR to RIR
Question: Did any one see any response back from DOL for their conversion request from Non-RIR to RIR? If yes how long did it take to get a response saying the conversion was complete?
Conversion from Non-RIR to RIR question
I'm in the process of converting from Non-RIR to RIR. My Lawyer is saying "If an employer has any layoffs 6 months prior to the filing of the labor certification, those individuals must be considered for any labor certification positions". Is this...
I'm also in the process of converting from Non-RIR to RIR. My Lawyer is saying "If an employer has any layoffs 6 months prior to the filing of the labor certification, those individuals must be considered for any labor certification positions". Is this correct? Do they have to review those...
I have also requested my attorney and they have agreed to file for conversion from Non-RIR to RIR. Anyone been successful with the conversion and how long did it take?
Thanks for the information. Since My PD is in 2003 I cannot change from Non-RIR to RIR without loosing my PD. So people who have their application filed before Aug 3, 2001 can change to RIR .
I agree labordrags, Keeping the PD is the most important thing. I checked with my company Lawyer again and this is what he said.
If you change from Non-RIR to RIR you will loose PD.
If you are beyond 6 year and on extension and if you loose PD then there is a chance that your extension will be...
My company lawyer told me, I'm under a NON-RIR outside 6year term and when I asked if I can change from NON-RIR to RIR or PERM, this is what my Lawyer told me. If not I would have changed long time ago.
