You are free to use "business necessity" if you'd like to. I don't see any rule in PERM that prevent you from doing so. Of cource your "business necessity" must be reasonable and you have to prepare for being audited.

I guess you need to show it is business necessity if your ad requires MS or BS+5.

Is it possible for the visa number to be increased? Was it ever increased in history to recover a retrogression?
