yours could have been an insolated case where they might have overlooked, but they specifically mention that they either need the original/photocopy of I797 according to their web site. http://travel.state.gov/hlop.html#5

Your application will probably be rejected for insufficient documentation, if you don't want to wait until that time, I would suggest you withdraw your application and re-apply with all the documentation. This might save you sometime.

You need to send your original I797 for stamping. You might want to keep copies of it before you send it.

ravi100..... I would suggest check the Chicago DOL thread, if you haven't done so already. Or you can call this number 312-353-1059 and select permanent applications and input your case number and see what it says. Hope this helps. regards, Sreddy227.

you can apply upto six months in advance, I applied for my 7th year in Feb'03 and my H-1 doesn't expire untill Aug'03, in your case you should be eligible to apply in August'03.
